Die Rechtslage bei der Bestellung eines Hotelzimmers DEHOGA Niedersächsischer Hotel- und Gaststättenverband

  1. Wird ein Hotelzimmer bestellt, zugesagt oder kurzfristig bereitgestellt, so ist ein Gastaufnahmevertrag zustande gekommen.
  2. Der Abschluss des Gastaufnahmevertrages verpflichtet die Vertragspartner für die gesamte Dauer des Vertrages zu Erfüllung der gegenseitigen Verpflichtungen daraus.
    1. Verpflichtung des Gastwirtes ist es, das Zimmer entsprechend der Bestellung bereitzuhalten.
    2. Verpflichtung des Gastes ist es, den Preis für die Zeit (Dauer) der Bestellung des Hotelzimmers zu bezahlten
  3. Nimmt ein Gast das bestellte Hotelzimmer nicht in Anspruch, so bleibt er rechtlich verpflichtet, den Preis für die vereinbarte Hotelleistung zu bezahlen, ohne dass es auf den Grund der Verhinderung ankommt. Dabei müssen nur tatsächliche Einsparungen des Betriebes abgesetzt werden.
  4. Die Einsparungen des Betriebes betragen erfahrungsgemäss bei der Übernachtung 20 %, bei Halbpensionsvereinbarungen 30 %, bei Vollpensionsvereinbarungen 40 % des vereinbarten Preises.
  5. Kann der Gastwirt das nicht in Anspruch genommene Zimmer anderweitig vergeben, so entfällt die Verpflichtung des Gastes zur Bezahlung in der Höhe der anderweitig erzielten Einnahmen für diesen Zeitraum.
  6. Der Gastwirt hat einen Anspruch auf Barzahlung aller Leistungen vor Abreise und dementsprechend ein gesetzliches Pfandrecht an den eingebrachten Sachen des Gastes.
  7. Gerichtsstand ist der Betriebsort, da auch im Falle der Nichtbeanspruchung des Zimmers die Leistungen aus dem Gastaufnahmevertrag am Ort des Betriebes zu erbringen sind.
